1. Agreement to Terms

By accessing or using GasUp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is provided by GasUp and its affiliates ("we," "us," or "our").

2. Description of Service

GasUp is a decentralized application (dApp) that enables users to:

• Swap stablecoins (such as USDC) for native blockchain tokens (such as ETH, SOL, OKB)
• Perform batch transfers of native tokens to multiple recipients
• Utilize gasless transactions through EIP-3009 authorization

The Service integrates with third-party decentralized exchanges including Uniswap and OKX DEX Aggregator to provide liquidity for token swaps.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements. You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

4. Wallet Connection and Security

To use the Service, you must connect a compatible cryptocurrency wallet. You are solely responsible for:

• Maintaining the security and confidentiality of your wallet credentials and private keys
• All activities that occur through your connected wallet
• Ensuring your wallet has sufficient funds for transactions and gas fees
• Verifying all transaction details before signing and confirming

5. Transaction Risks

You acknowledge and accept that:

• Cryptocurrency transactions are irreversible once confirmed on the blockchain
• Token prices are volatile and may change significantly between transaction initiation and execution
• Slippage may occur, resulting in receiving fewer tokens than initially quoted
• Smart contract interactions carry inherent risks, including potential bugs or vulnerabilities
• Network congestion may cause transaction delays or failures
• We do not guarantee the availability of any particular exchange rate or liquidity

6. Fees

The Service may charge protocol fees on transactions. These fees will be clearly displayed before you confirm any transaction. Additionally, you are responsible for paying all applicable blockchain network fees (gas fees), which vary based on network conditions and are not controlled by us.

7. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to manipulate or exploit the Service or its underlying smart contracts
• Use the Service to launder money or finance terrorism
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems or bots to interact with the Service without authorization

8. Third-Party Services

The Service integrates with third-party services including wallet providers, blockchain networks, and decentralized exchanges. We are not responsible for the availability, reliability, or security of these third-party services. Your use of third-party services is subject to their respective terms and conditions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

You agree to indemnify, defend, and hold harmless GasUp and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

We reserve the right to modify or discontinue the Service at any time without notice. We may also update these Terms from time to time. Continued use of the Service after any changes constitutes acceptance of the new Terms.
